These Terms & Conditions apply exclusively to purchases made through pearcebargains.co.uk. Purchases made through any other platform, including but not limited to eBay, are subject to that platform's own terms and policies.

Product Handling, Storage, and Onward Supply

Once a product has been delivered to you, you are responsible for its storage, handling, and use in accordance with any instructions or guidance provided on the product packaging. We accept no liability for any adverse reaction, illness, or loss arising from the improper storage, handling, or use of a product after delivery, or from the failure to check the product packaging for allergen information, ingredients, or usage instructions prior to consumption or use.

If you provide, distribute, or make available any product purchased from us to a third party, whether with or without its original packaging, you accept full responsibility for ensuring that the recipient is made aware of all relevant product information, including ingredients, allergen content, Best Before End dates, and any applicable usage or storage instructions. We accept no liability for any adverse reaction, illness, loss, or damage suffered by any third party to whom you have provided a product purchased from us.

Risk and Title

Risk in the products passes to you on delivery, meaning you become responsible for the products, including their safe storage, once they have been delivered to the address provided at checkout. Title (ownership) in the products passes to you once we have received payment in full.

Right to Correct Errors

We reserve the right to correct any errors, inaccuracies, or omissions relating to product descriptions, pricing, images, availability, or other information on our website at any time, including after an order has been placed. If such a correction materially affects an order you have placed and the contract has not yet been formed through dispatch, we will notify you and you will be entitled to a full refund.

Best Before End Dates

A significant number of the products we sell are past or approaching their Best Before End (BBE) date. This is clearly displayed on each product listing wherever the product appears on our website. The BBE date shown on our website represents the latest possible date — the product you receive will carry that date or an earlier date, but never a date later than the one advertised.

Best Before End dates refer to the quality of a product, including taste, texture, and aroma, and do not indicate that a product is unsafe to consume after that date. We do not sell products that have passed their Expiry Date or Use By date. Expiry Dates and Use By dates are distinct from Best Before End dates and relate to product safety rather than quality.

By placing an order with us, you acknowledge and accept that you are purchasing products that may be past or close to their Best Before End date. You accept that such products may differ in taste, texture, or appearance compared to the same product within its Best Before End date, and that this is inherent to the nature of the products we sell.

This is one factor, alongside price and all other relevant circumstances, which is taken into account when assessing satisfactory quality under the Consumer Rights Act 2015. Nothing in this clause removes or reduces your statutory rights. The decision to consume any product is at your sole discretion and responsibility.

Pricing and Payment

All prices displayed on our website are in pounds sterling (GBP) and are inclusive of VAT where applicable. While we make every effort to ensure that pricing on our website is accurate, errors may occur. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price. If we cancel your order due to a pricing error, we will notify you and issue a full refund.

We accept payment via Visa, Mastercard, American Express, Apple Pay, Google Pay, Shop Pay, UnionPay, Maestro, Discover, and Diners Club. Payment is taken at the time your order is placed. All payment transactions are processed securely through Shopify's payment infrastructure.

Contract Formation

When you place an order through our website, this constitutes an offer to purchase the products in your order. An automated order confirmation email is sent to acknowledge that we have received your order, but this does not constitute acceptance of your offer. A legally binding contract between you and us is formed only when we dispatch your order. Until that point, we reserve the right to decline or cancel your order for any reason, including stock unavailability, pricing errors, suspected fraud, or a breach of these Terms & Conditions. If we cancel your order prior to dispatch, we will notify you and issue a full refund.

Our Right to Refuse or Cancel Orders

We reserve the right to refuse, cancel, or limit any order at our sole discretion. Circumstances in which we may exercise this right include pricing or product listing errors, suspected fraudulent activity, suspected breach of these Terms & Conditions, stock unavailability, orders that we believe are placed by or on behalf of resellers or competing businesses, and orders that breach any quantity restrictions in place at the time. This list is not exhaustive. If we cancel an order, you will be notified and refunded in full for any payment already taken.

Fraud Prevention

We reserve the right to delay dispatch while carrying out reasonable fraud prevention checks where we believe an order presents an elevated fraud risk. This may include verifying payment details, contacting the customer to confirm the order, or liaising with our payment provider. We shall not be liable for any delay resulting from such checks.

Duplicate Orders

Where we reasonably believe that multiple identical orders have been placed in error, we may contact you to verify your intentions before dispatch. If we are unable to reach you within a reasonable timeframe, we may dispatch a single order and refund the remainder. If you confirm that all orders were placed intentionally, we will dispatch each order accordingly. Nothing in this clause restricts your ability to place multiple orders deliberately.

Quantity Limits

Certain products, particularly those on sale or offered at promotional pricing, may be subject to quantity limits per customer. Where a quantity limit applies, this will be clearly stated on the relevant product listing and enforced at checkout. Any attempt to circumvent quantity restrictions, whether by placing multiple orders, using different delivery addresses, or any other means, may result in the cancellation of the offending order. We reserve the right to cancel only the order that breaches the restriction, and the customer will be refunded for any cancelled order.

Discount Codes, Promotions, and Free Delivery

We may from time to time offer discount codes, coupon codes, or promotional offers. Each discount code or promotion may carry its own specific terms and conditions which will be communicated at the time the offer is made. Unless otherwise stated, discount codes are not to be shared, resold, or published without our express permission, may only be used once per customer, may not be combined with other offers or discount codes, and may be withdrawn by us at any time without notice.

Discount codes may be used in conjunction with our standard free delivery threshold unless explicitly stated otherwise. We offer free standard delivery on orders of £20 or more. This threshold is calculated based on the total value of products in your order after all discounts have been applied, and does not include any delivery charges. For example, if a discount reduces your order total below £20, the free delivery threshold will not be met and standard delivery charges will apply.

Any attempt to misuse, exploit, or circumvent the terms of a discount code or promotion may result in the cancellation of the offending order and the discount being voided. Creating multiple customer accounts is permitted, but creating accounts for the purpose of bypassing discount restrictions or quantity limits is not. Where we identify misuse, we reserve the right to either cancel the order or request that the full, non-discounted price be paid before the order is fulfilled. Repeat offenders may be blocked from placing future orders on our website.

Flash sales, limited-time offers, and other time-sensitive promotions will be subject to availability. We reserve the right to end any promotion early and without notice.

Business and Trade Purchases

Our website is primarily intended for consumers purchasing products for personal use. If you are purchasing wholly or mainly for business purposes, including for commercial use or with the intention of reselling, your order is classified as a business-to-business (B2B) transaction. B2B transactions are not covered by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or other consumer protection legislation. As such, business buyers are not entitled to a statutory cooling-off period or the right to cancel for a change of mind, and our standard consumer returns policy does not apply.

While we endeavour to ensure that our products are of satisfactory quality, you acknowledge that many of our products are sold past their Best Before End date, that this is clearly communicated at the point of purchase, and that the quality of such products is assessed in light of that description, their price, and all other relevant circumstances in accordance with the Consumer Rights Act 2015.

Nothing in these Terms & Conditions is intended to exclude or restrict any term implied by the Consumer Rights Act 2015 or any other consumer protection legislation that cannot lawfully be excluded. Your statutory rights as a consumer are not affected.

Indemnification

You agree to indemnify Conrad Pearce Neville (trading as Pearce Bargains) from and against any claims, liabilities, damages, losses, and reasonable legal expenses arising directly out of your breach of these Terms & Conditions or your unlawful use of our website. This indemnity does not apply to the extent that any claim, liability, damage, loss, or expense arises from our own negligence, breach of these Terms & Conditions, or breach of applicable law, and nothing in this clause affects your statutory rights as a consumer.

Force Majeure

We shall not be liable for any delay or failure in performing our obligations under these Terms & Conditions where such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemic or epidemic, industrial action or strikes, postal or courier service disruption, government action or regulation, supplier failure, utility failure, cyberattack, or any other event that could not have been reasonably foreseen or avoided. In such circumstances, our obligations shall be suspended for the duration of the event and we will make reasonable efforts to resume performance as soon as practicable.

If any provision of these Terms & Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms & Conditions and shall not affect the validity or enforceability of the remaining provisions.

Governing Law and Disputes

These Terms & Conditions are governed by and construed in accordance with the laws of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you will also benefit from any mandatory consumer protections available to you under the laws of your country of residence.
